Please read these Terms & Conditions ("Terms") carefully before using the website, mobile applications, ordering products or otherwise using services offered by Shree Vyankatesh Food Services ("we", "our", "us"). These Terms govern your access to and use of our website and Services, including purchase of premix food products such as chakali, anarase, puran poli, dry coconut, idli, dosa, uttapa, karanji and thalipith (the "Products").

By accessing or using the Services, placing an order, or creating an account you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Definitions

• Services — the website, mobile apps, ordering, checkout, delivery and related services provided by Shree Vyankatesh Food Services.
• You / User / Customer — any person who visits the website, places an order, or uses the Services.
• Order — a request to purchase Products placed by you through our website.
• Seller / Company — Shree Vyankatesh Food Services, registered and operating from Maharashtra, India.

2. Eligibility

You must be at least the minimum age required by applicable law to create an account and enter into a contract. By using the Services you represent and warrant that you are legally capable of entering into binding contracts.

3. Account registration & security

• When you create an account you must provide accurate, current and complete information. You agree to keep this information up to date.
• You are responsible for maintaining the confidentiality of your account credentials and are fully liable for all activity that occurs under your account. Notify us immediately of any unauthorized use.
• We may suspend or terminate accounts that violate these Terms or for security reasons.

4. Placing orders & acceptance

• All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason (including unavailability of stock, pricing errors, suspected fraud, or issues with verification).
• When you place an order you will receive an order acknowledgement. This acknowledgement is not an acceptance — acceptance occurs when we confirm the order for fulfilment (for example by sending a dispatch confirmation).
• We may require additional verification (identity, payment, address) before accepting an order.

5. Prices, taxes & payment

• Prices shown on the site are in Indian Rupees (INR) and may include or exclude taxes as specified at checkout. Applicable taxes (GST etc.) and shipping charges will be clearly displayed during checkout.
• We reserve the right to correct pricing errors and to modify prices at any time. If a pricing error occurs after you place an order, we may cancel the order and refund any payment already made.
• Payments are processed via third-party payment processors. We do not store full payment card details. You agree to provide current and valid payment information.
• By placing an order you authorize us (and our payment processors) to charge the amount for the Products and applicable taxes, fees and delivery charges.

6. Delivery, title & risk

• Delivery times are estimates only and may vary due to location, stock, force majeure, or courier delays. We are not liable for delivery delays beyond our control.
• Title and risk of loss for Products pass to you upon delivery to the address you provided. Please inspect goods on delivery and notify us promptly of any issues.

7. Cancellation, returns & refunds

Because our Products are food items and for hygiene reasons, we operate a limited returns policy:

Cancellation:

• You may cancel an order free of charge before it has been dispatched. Once dispatched, cancellation may not be possible.

Returns & refunds (damaged/defective/wrong item):

• We accept claims for damaged, defective or incorrect Products only. Claims must be reported within 48 hours of delivery by emailing privacy@vyankateshfoods.com (or calling the number below) and must include photographic evidence and order details.
• We will evaluate claims and may require the Product (or packaging) to be returned or otherwise made available for inspection. Where a claim is accepted, we will, at our option, replace the Product or issue a refund. Refunds will be processed to the original payment method within a reasonable time (normally within 14 business days after acceptance).
• We do not accept returns for change-of-mind or for Products that have been opened, used or where packaging is unsealed (unless the Product is defective or contaminated).

8. Product information, samples & allergen notice

• We strive to describe Products accurately (ingredients, net weight, best-before dates). However, product images are illustrative — actual product packaging may vary.
• Our Products may contain or have been processed in facilities that handle nuts, sesame, dairy, wheat, soy, or other allergens. If you have allergies or dietary restrictions, do not rely solely on the website descriptions; check the product packaging and contact us for clarification before ordering. We are not liable for allergic reactions if you failed to inform yourself of ingredient/allergen information.
• Follow storage and preparation instructions on the packaging. Do not consume Products that appear spoiled or contaminated.

9. Prices for bulk, promotions & coupons

Promotional offers, discounts, and coupon codes are subject to terms and may be withdrawn at our discretion. Only one coupon may be applied per order unless explicitly stated. Coupons cannot be exchanged for cash.

10. Intellectual property

• The content on the website (text, images, logos, design, code) is our intellectual property or used under license. You may view or print content for personal, non-commercial use only.
• You may not copy, reproduce, republish, upload, post, transmit, distribute, modify or create derivative works from our content without our express written permission.

11. User conduct

You agree not to:

• Use the Services for unlawful purposes or violate applicable laws;
• Interfere with the operation of the Services or access them using automated means (bots) except where expressly permitted;
• Post or transmit content that is offensive, abusive, defamatory, infringing, or that violates someone's privacy or proprietary rights;
• Attempt to gain unauthorized access to other accounts, systems, or networks.

We reserve the right to remove content, refuse service, or suspend accounts that violate these Terms.

12. Links to third-party sites & services

The website may link to third-party websites or use third-party services (payment gateways, logistics partners). We are not responsible for the content, privacy practices or availability of those third-party sites. Your use of third-party services is subject to their own terms and policies.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Services and Products are provided "as is" and "as available" without any warranties, express or implied (including merchantability, fitness for a particular purpose, non-infringement). We do not warrant that the website will be uninterrupted, error-free or free of harmful components.

14. Limitation of liability

To the maximum extent permitted by applicable law:

• Our total aggregate liability for any and all claims arising out of or related to these Terms or your use of the Services is limited to the total amount paid by you for the relevant Order(s) during the 12 months preceding the claim.
• We are not liable for indirect, incidental, consequential, punitive or special damages (including lost profits, loss of goodwill, or loss of data) even if we were advised of the possibility of such damages.
• These limitations will not apply where prohibited by law.

15. Indemnity

You agree to indemnify and hold harmless Shree Vyankatesh Food Services and its officers, directors, employees and agents from any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms, your negligence, your violation of law, or your use of the Services.

16. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control (acts of God, pandemics, strikes, fire, flood, civil unrest, government actions, supplier failures, network outages, etc.). In such events we may suspend performance and will use reasonable efforts to resume as soon as practical.

17. Suspension & termination

We may suspend or terminate access to the Services, or cancel Orders, if you breach these Terms, or for operational or security reasons. Termination does not affect rights and obligations that accrued prior to termination.

18. Changes to Terms

We may modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date and will take effect immediately unless otherwise stated. Your continued use of the Services after posting of amended Terms means you accept the changes.

19. Governing law & dispute resolution

These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India, unless otherwise required by applicable law. Before initiating formal legal proceedings, both parties will try in good faith to resolve disputes through direct negotiations.

21. Consumer laws & statutory rights

These Terms do not affect any statutory rights you cannot waive under applicable consumer protection or other laws in India. If any part of these Terms is found to be unenforceable, that part will be severed and the remainder will remain in effect.

22. Miscellaneous

• Entire agreement: These Terms, together with our Privacy Policy and any other policies posted on the site, form the entire agreement between you and us regarding the Services.
• No waiver: Failure to enforce a provision of these Terms does not waive our right to enforce it later.
• Assignment: We may assign these Terms or our rights to any affiliate or purchaser; you may not assign your rights without our prior written consent.
